General Terms and Conditions of Purchase
These General Terms and Conditions govern the contracting of products and services through the FUSTIBUS platforms (including, among others, fustibus.com and fustibuscoworking.com), in accordance with Royal Legislative Decree 1/2007 of 16 November (Spanish Consumer Law, "TRLGDCU"), Law 34/2002 on Information Society Services (LSSI-CE) and Directive 2011/83/EU.
The customer expressly accepts these terms when confirming the purchase. FUSTIBUS recommends printing or saving a copy.

2. Scope of Application
These conditions apply to the contracting of the following products and services:
- Recurring digital services (SaaS): FUSTIBUS software licences with monthly or annual plans and automatic renewal unless cancelled.
- Domain registration and renewal: processed through the relevant registries (ICANN for .com/.net/.org, Red.es for .es, etc.).
- Web hosting and VPS servers: shared hosting and virtual private servers with periodic billing.
- SSL certificates and professional email issued by the relevant certificate authorities or providers.
- Professional services: custom software development, migration, integration, consulting and technical support.
- Coworking space reservations and rentals: workstations, meeting rooms, private offices, training rooms and events.
- Events and training: conferences, workshops and in-person or online courses.
- Memberships: recurring fees with access or usage rights.
Nature of the services: FUSTIBUS does not sell physical products subject to courier shipping. All services are delivered electronically (SaaS, hosting, domains, SSL certificates, online training) or on-site at the provider's premises (coworking, events, in-person training). For this reason, no shipping policy, transport costs or physical-goods delivery times apply.
3. Customer Profile: Consumer vs. Business (B2B)
The specific protections in the TRLGDCU (right of withdrawal, legal warranty, consumer forum, etc.) only apply to those contracting as consumers (natural persons acting for purposes outside their business or profession, art. 3 TRLGDCU).
Customers contracting as a business or professional (B2B), identifying with a business tax ID and requesting an invoice in the entity's name, are not covered by these protections. B2B relationships are governed by Spanish commercial law and any individual agreements signed.
4. Contracting Process
- Product or service selection: the customer selects the plan, quantity and, where applicable, period (monthly / annual).
- Registration or sign-in: the customer creates an account or signs in.
- Billing information: the customer provides the data required for invoicing (name/company, tax ID, address).
- Acceptance of terms: before payment, the customer expressly accepts these Terms, the Privacy Policy and, where applicable, the Returns and Withdrawal Policy.
- Express consent for immediate execution: for services that start immediately (domains, hosting, VPS, SSL, SaaS) the customer acknowledges, through a specific checkbox before payment, that they request immediate execution and will therefore lose the right of withdrawal once the service is delivered (art. 103.a, 103.k and 103.m TRLGDCU).
- Payment: the customer pays using one of the available methods.
- Confirmation: the customer receives by email the confirmation, the simplified invoice and, where applicable, service access credentials.
5. Prices and Payment Methods
5.1 Prices
- All prices displayed to consumers include applicable VAT (21% in mainland Spain, subject to special regimes for the Canary Islands, Ceuta and Melilla).
- EU B2B intra-community transactions are billed without VAT when the customer provides a valid VAT-ID verified via VIES; otherwise Spanish VAT applies.
- The total price including taxes and, when applicable, shipping or setup fees, is shown before payment confirmation.
- FUSTIBUS may update prices, without affecting confirmed purchases or already-billed periods of recurring services. Price changes for subscriptions will be communicated with at least 30 days' notice.
5.2 Payment Methods
- Credit or debit card (Visa, Mastercard, American Express).
- Bank transfer (for periodic billing and professional services).
- SEPA direct debit (for SaaS subscriptions, hosting and memberships).
Payments are processed through PCI-DSS certified gateways (Stripe, PayCommet and similar) with TLS encryption. FUSTIBUS does not store the customer's full card data.
6. Recurring Subscriptions and Automatic Renewals
SaaS services, hosting, VPS, SSL certificates, professional email, domains and memberships are typically contracted as auto-renewing subscriptions:
- The service renews for the same period (month or year) unless cancelled before the renewal date.
- FUSTIBUS will send an email reminder 15 to 7 days before each significant renewal (>€50/year or equivalent).
- The customer can cancel the renewal at any time from the customer area or in writing to hola@fustibus.com. Cancellation takes effect at the end of the current period, with no refund of amounts already charged unless provided by the Returns Policy.
- If the renewal payment is declined, FUSTIBUS will notify the customer who will have up to 14 days to regularise before service suspension.
7. Confirmation and Invoicing
- After payment, the customer receives confirmation by email within 24 hours (usually instantly).
- The electronic invoice is sent by email and available in the customer area.
- For recurring services, an invoice is issued for each billed period.
- Invoices comply with Spanish billing regulations (RD 1619/2012) and, where applicable, with VeriFactu/SII.
8. Right of Withdrawal (Consumers)
The consumer has 14 calendar days from the contract date to withdraw without cause, under art. 102 TRLGDCU, except in the cases excluded by art. 103.
The detailed deadlines, refund amounts and excluded cases per product are developed in the Returns and Withdrawal Policy, which is an integral part of these Terms.
8.1 Services that start immediately
Under art. 103 TRLGDCU, withdrawal does NOT apply when the service has started or been executed at the consumer's express request before 14 days, notably:
- Domain registration and renewal (.com, .es, .net, .org, etc.): processed irreversibly with the registry; the cost is not recoverable. The consumer acknowledges losing the right of withdrawal from the registration moment (art. 103.a and 103.m).
- Activated hosting, VPS and cloud services: once the server is provisioned with the customer's express consent, no withdrawal applies for the consumed period. Only the unused period will be refunded proportionally, if provided by the Returns Policy.
- Issued SSL certificates: once issued by the certificate authority, they cannot be returned (art. 103.a).
- SaaS software with access already delivered: if the customer has accessed the panel and accepted the loss of the right of withdrawal, no refund applies for the consumed period.
- Professional services in progress: work already performed (analysis, development, migration) will be billed in proportion to the effort executed, under art. 108 TRLGDCU.
9. Cancellation of Reservations, Events, Training and Memberships
Space reservations, event tickets, training and memberships are excluded from the 14-day general withdrawal (art. 103.l TRLGDCU) because they are tied to specific dates. The voluntary tiered policy described in the Returns Policy applies.
10. Service Level Agreement (SLA) and Compensation
For hosting, VPS and SaaS, FUSTIBUS aims to maintain monthly availability of 99.9% uptime measured on our own infrastructure, excluding:
- Scheduled maintenance announced at least 48 hours in advance.
- Force majeure (catastrophes, upstream provider outages, massive DDoS attacks, etc.).
- Incidents caused by customer software or third-party configurations.
If monthly uptime falls below the commitment due to causes attributable to FUSTIBUS, the customer may request a credit or proportional discount for the affected period, up to the price of the service in the relevant month. SLA claims must be sent in writing to hola@fustibus.com within 30 days of the affected month.
11. Suspension and Termination for Breach
- Non-payment of the subscription triggers a notice to the customer. If not regularised within 14 days, FUSTIBUS may suspend the service. After 30 days of non-payment, the contract may be terminated and data deleted per section 13.
- Abusive use of services (mass spam from hosting, illegal activity, infringement of third-party rights, unauthorised cryptocurrency mining, etc.) entitles FUSTIBUS to suspend the service without refund.
- The customer may terminate at any time if FUSTIBUS materially breaches its obligations, with a refund of the unused proportional part.
12. Liability and Limitations
- FUSTIBUS provides the services "as is" within the commitments described in these Terms and the documentation of each product.
- The total aggregate liability of FUSTIBUS to the customer for any claim arising from the contracted services shall not exceed the amount paid by the customer in the 12 months preceding the event giving rise to the claim, except for wilful misconduct or gross negligence.
- FUSTIBUS is not liable for lost profits, customer-caused data loss, or indirect or consequential damages.
- The customer is responsible for maintaining its own data backups, without prejudice to the backups offered by FUSTIBUS as part of the service.
13. Data Processing and Retention
Personal data is processed under Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). See the Privacy Policy for purposes, legal basis, retention periods and rights.
After service cancellation, hosted data (files, databases, backups) is kept for 15 calendar days to allow customer recovery or export, and is permanently deleted thereafter, unless legally required to retain.
14. Intellectual Property
FUSTIBUS's software, trademarks, content and materials are owned by it or its licensors and are protected by intellectual and industrial property laws. The contract grants the customer a non-exclusive, non-transferable right of use limited to the contracted period.
The customer retains ownership of its own content, data and developments uploaded to the platform. FUSTIBUS will treat them as confidential and access them only as necessary to provide the service or comply with legal requirements.

Complaints will be addressed within a maximum of 30 calendar days. The consumer may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
16. Applicable Law and Jurisdiction
These terms are governed by Spanish law. For consumers, the parties submit to the Courts and Tribunals of the consumer's domicile (art. 52.3 LEC). For B2B customers, the parties expressly submit to the Courts and Tribunals of the city where FUSTIBUS's registered office is located, waiving any other jurisdiction.
17. Validity, Modifications and Languages
If any clause is declared null or unenforceable, the rest will remain valid. FUSTIBUS may modify these terms due to regulatory or service changes, notifying active customers at least 30 days in advance; the version in force at the time of each contracting or renewal will apply. The binding version is the one drafted in Spanish; translations to other languages are provided for informational purposes only.
